1. About these terms

These terms govern your use of the Ecom Outpost website at ecomoutpost.com (the "Site"), operated by KOURKE LLC ("Ecom Outpost", "we", "us"). By using the Site, you agree to these terms. If you don't agree, please don't use the Site.

Our Privacy Policy explains how we handle information about you.

2. What Ecom Outpost is

Ecom Outpost is a discovery service that helps you find independent online stores and their products.

• We don't sell products. The stores listed on the Site do. When you buy something, you buy it from that merchant, on the merchant's own website and checkout.
• The merchant is responsible for the sale. This includes pricing, payment, taxes, shipping, delivery, returns, refunds, warranties, product safety and customer service. Questions or problems with an order go to the merchant.
• We aren't a party to your purchase. We don't process payments for merchants' orders and don't receive your payment details.

3. Listings and accuracy

• Store and product information on the Site comes from the merchants, through their store platforms such as Shopify, and may change at any time.
• We work to keep listings current, but prices, availability and other details on the Site may be out of date or incomplete. The information on the merchant's own website at the time you buy is what applies.
• We review stores before they appear and may hide or remove listings that break our rules. We don't verify every product claim, and a listing on the Site isn't an endorsement of any merchant or product.

4. Search results and sponsored placements

• Search results and recommendations are based on relevance to what you're looking for, along with other factors such as listing quality. Merchants can't pay to change the order of regular results.
• Some placements are paid for by merchants. They're labeled Sponsored, and a Sponsored product appears only when it matches what you searched for.
• Ecom Outpost's operators also own some of the stores listed on the Site. When we promote one of those stores, it's labeled From our own store.
• Some stores are listed from public information without having connected to Ecom Outpost.

5. Links to other websites

The Site links to merchants' websites and other third-party sites. We don't control them and aren't responsible for their content, products, services or privacy practices. Your use of those sites is governed by their own terms and policies.

6. Using the Site

You agree not to:

• use the Site in a way that breaks any law or infringes anyone's rights;
• interfere with or disrupt the Site, its security or its infrastructure, or try to gain unauthorized access;
• use bots, scripts or other automated means to access, copy or collect content from the Site in bulk, except as allowed by our robots.txt file or with our written permission;
• copy, republish or sell the Site's content, or use it to build a competing database or service; or
• misrepresent yourself or your connection with any person or business.

We may limit or block access to the Site to protect it or its users.

7. Content and intellectual property

• Ecom Outpost content: the Site's design, text, graphics, logos and software belong to Ecom Outpost or its licensors and are protected by intellectual property laws. The Ecom Outpost name and logo are our trademarks.
• Merchant content: store names, product names, descriptions, images and trademarks shown in listings belong to the merchants or their licensors.
• You may use the Site for your own personal, non-commercial shopping. Nothing in these terms gives you any other right to use our content or merchants' content.

8. Reporting a problem

If you believe a listing is inaccurate, misleading, unsafe, infringes your rights, or otherwise breaks our rules, email support@ecomoutpost.com. Please include the page address and a description of the problem.

Copyright complaints: if you believe content on the Site infringes your copyright, email support@ecomoutpost.com with: your contact details; the work you believe is infringed; the page address of the content; a statement that you believe in good faith that the use isn't authorized; and a statement that your notice is accurate and that you own, or are authorized to act for the owner of, the copyright. We'll review it and remove or disable the content where appropriate.

9. Disclaimers

The Site is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind about the Site or any listing, product or merchant, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't guarantee that the Site will be uninterrupted, error-free or secure.

10. Limitation of liability

To the fullest extent the law allows:

• Ecom Outpost won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the Site, or from any purchase from or dealing with a merchant.
• Our total liability for any claim relating to the Site won't exceed US$100.

Some places don't allow these limits, so they may not apply to you.

11. Changes to the Site and these terms

We may change or discontinue any part of the Site. We may update these terms by posting the new version on this page with a new "Last updated" date. If you keep using the Site after an update, you accept the new terms.

12. Governing law and disputes

These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Before starting a legal claim, please email us at support@ecomoutpost.com so we can try to resolve the issue informally. Any legal claim must be brought in the state or federal courts located in Fulton County, Georgia, unless the law where you live gives you the right to bring it elsewhere.

13. General

• If any part of these terms can't be enforced, the rest still applies.
• If we don't enforce a term, that doesn't waive our right to enforce it later.
• These terms, together with the Privacy Policy, are the entire agreement between you and Ecom Outpost about the Site.
